ATA: Recent LA Port court ruling a ‘non event’

LOS ANGELES –The American Trucking Associations says pretty much nothing has changed at the Port of Los Angeles, even though the 9th Circuit Court of Appeals refused to allow eight concession agreements to continue as part of the controversial Clean Trucks program.

But no problem, says ATA. The court only rejected ATA’s request for injunctions on "minor" concessions. It doesn’t change an injunction the ATA won last March against the Port’s ban on owner-operators.

The Teamsters has been pushing for an all-union driver mandate for drayage carriers that work the port.

"It’s pretty much status quo," said ATA spokesperson Clayton Boyce, calling the court decision "a non-event."

In fact, the Circuit Court of Appeals ruled to keep all but one concession, which required all trucks serving the Port to have a placard identifying the truck with a telephone number, which is a "win" for carriers, says Boyce.

While the court ruling confirms the Ports’ right to continue restricting older, higher-polluting truck engines from entering the port, the legal battle over the Clean Truck program still isn’t over.

Next month, a federal court will decide whether to grant the ATA’s request to ban all of the Port’s concessions, and one from the Port asking the court to dismiss the case.
