Ontario’s Gravel Haulers Get Short-Term Reprieve from MTO

TORONTO — The Ontario Ministry of Transportation (MTO) has agreed to temporarily suspend axle-weight enforcement until the rules get sorted out, which should be by the end of the calendar year.

The announcement came in a letter from Peter Hurst the Director of the MTO’s Carrier Safety and Enforcement Branch.

The ruling applies to aggregate haulers only.

And inspectors will still charge haulers if their gross weight exceeds their allowable limit by 2,001 kg or more.

“Operators will be required to remove a portion of the load only when the amount of the overload exceeds the allowable gross weight by more than 3,000 kilograms for vehicles or combinations with five axles or less and 5,000 kg for vehicles or combinations with six axles or more.

The amount of the overload must then be corrected to within 2,000 kg of the allowable gross weight,” the letter states.

But there will be no charges imposed for improper load equalization under sections 115 (tires), 116 (axle units) and 117 (axle groups) of the Highway Traffic Act.

The suspension of axle-weight enforcement will resume Jan.1, 2014.

The Ministry hopes by that time to have developed a long-term solution to the problems faced by the aggregate haulers.
