Halton Hills, Ont., struggling to uproot illegal truck yards sprouting on farmland
The Town of Halton Hills is facing an uphill battle with illegal truck yards that are growing on prime farmland.
“We’re faced with illegal land use,” Mayor Ann Lawlor said. “Trucking operations are setting up in places that are inappropriate for that use. They come in at night, bring in fill, create roads, fill in creeks, and contaminate the soil. It’s devastating our countryside.”
Officials have identified more than 50 illegal truck depots in the town with a population of around 65,000 residents. Part of the Regional Municipality of Halton, the town lies in the northwestern end of the Greater Toronto Area.

The town’s southern border conveniently sits along Highway 401 and some trucking operations have been quick set roots on prime agricultural land without bothering to apply for proper permits.
80 charges laid
Halton Hills currently has more than 40 active investigations and has laid more than 80 charges against more than 10 properties. Convictions have been secured for roughly 15 to 20 sites, but each prosecution consumes scores of staff hours and takes two to five years to resolve. Even the largest fine to date — about $115,000 — has not come close to covering the costs.
A drive along Steeles Avenue on the town’s southern border, between Trafalgar Road and Winston Churchill Boulevard, reveals the extent trucking operations have sprouted in the area. Farmland has been fenced off, while trucks and trailers sit in hastily paved off areas monitored by cameras. “Truck parking available” signs are also prevalent.

“These operations are eyesores,” Lawlor said. “We get complaints about noise, lighting, and traffic. The way our land is used is important to us, and we’re not going to stop enforcing appropriate use of the land in Halton Hills. We’ll keep chipping away at it, even if for some it’s seen as the cost of doing business.”
The town says it is struggling due to the current Provincial Offences Act process, which requires lengthy court proceedings for zoning violations. Each case must go through multiple adjournments and filings, stretching resources thin.
Two years per case
“We have five officers,” said Susie Spry, the town’s manager of enforcement services. “They enforce every bylaw for the town, everything from noise to animal control. All our convictions so far have gone through Provincial Offences court, which means months of preparation, sworn documents, court dates, delays, and adjournments. We’re looking at about two years minimum per case.”
To address the backlog, council approved a new Administrative Monetary Penalty System (AMPS) bylaw in January 2025, allowing staff to issue fines directly for most municipal infractions. The system covers all regulatory bylaws under the Municipal Act — except zoning, which falls under the province’s Planning Act.

Spry said the new AMPS bylaw, approved by council earlier this year, allows the town to issue fines right away rather than waiting for court proceedings. She explained enforcement officers can now issue continuing offense notices that add up daily until a violation is resolved. However, zoning cases still fall under the provincial court system, a gap she said the province needs to fix.
Halton Hills and other municipalities are urging the Ontario government to amend Section 67 of the Planning Act to allow AMPS to apply to zoning offenses. The shift would let municipalities issue penalties for illegal land use directly, bypassing the court process entirely.
Quicker timeframe sought
Under the proposed system, municipalities could resolve violations in weeks rather than years, reduce staff time and legal costs, and ease pressure on an already congested court system. The town argues that quicker penalties would deter illegal activity early and encourage compliance before environmental damage occurs.
Lawlor said amending the Planning Act “would be the biggest change” municipalities could receive from Queen’s Park. “It would also be helpful if we had more court time,” she added. “Our court system in Halton is very clogged up, and we have limited time to present these cases.”
The campaign builds on a 2024 Halton Hills resolution supporting the Town of Caledon’s call for stronger provincial enforcement powers. That motion urged Ontario to allow municipalities to bar entry to properties engaged in illegal land use posing safety or environmental risks, and to raise fines to $50,000 for individuals and $100,000 for corporations on first conviction, with additional daily penalties for ongoing violations.
AMPS program
In November 2024, Spry presented a staff report recommending the expansion of Halton Hills’ AMPS program — previously used for parking infractions — to cover other regulatory bylaws, such as site alteration and property standards. The report cited public support for the move, noting that 77% of residents backed the broader use of administrative penalties, with 71% describing them as fair.
The system, that took effect in April 2025, is aimed at reducing case resolution times from years to about 30 days. It also allows escalating fines for repeat violations, giving enforcement officers new leverage without additional staffing.
Higher fines for rule violators
Spry said the town has no plans to hire additional enforcement officers but noted that fines will be significantly higher for those violating municipal rules. She said the tougher penalties are meant to deter repeat offenders and encourage quicker compliance.
Lawlor said the changes are about protecting Halton Hills’ quality of life and preserving farmland for future generations. The mayor added that the town remains committed to protecting the character of its community. Although the illegal truck yards are significantly and negatively affecting that quality of life, the town will not give up the fight, she added.

These illegal trucking businesses not only impact the true trucking business as a whole they impact conservation, water supplies, farmers and the law. Time to fine them, take licenses away, and if necessary jail time.

Yes! However this industry is vital to the economics of HH and surrounding communities. How about HH create a large parking facility in an appropriate location. Collect fees and provide security. It would pay for itself. The hydro right-of-way on Steels Avenue for example.

They are indeed an eyesore and the offenders know they will not be prosecuted in a quick manner, while they continue to operate illegally. Ridiculous that we all have to sit back and watch as they destroy our countryside and could care less about our laws and regulations.

So basically the Mayor wants to eliminate due process. The “preserve valuable farmland” and “environmental damage” cry is an absolute joke. Thousands of acres of way better farmland is destroyed every week for industrial and residential wastelands. She’s just gripping ’cause they are missing a tax base…. say it the way it is Mayor..
They come through illegal routes in Canada by first getting either student visa or visitor visa and then pickup a yellow flag only to claim refuge, so of course they would do all illegal businesses in Canada. Canadian government needs to reform their refugee claiming processes to stop these kind of practices. And as an immediate solution, DEPORT THEM.
The Ontario Civil Remedies Act, 2001 allows the Attorney General to ask courts to seize property that is the result of or is used in unlawful activity through a process called civil forfeiture. Funds from forfeited assets are placed in a special account to be used for costs, compensation to victims, or grants to support law enforcement and community programs that assist victims and prevent crime. This remedy doesn’t require a conviction of the owners. Also success is based on “probability” less onerous than Provincial Offence Act. Strangely, the property is found libel.
The illegal use of pristine farmland for truck storage parking is a disgrace. The Ontario government and Doug Ford need to wake up and amend legislation so this blight on the landscape can be removed quickly. The operators of these sites just want a quick dollar and don’t give a dam about the impact on community, infrastructure of the environment. They fester and multiply like and ugly offensive sore on the landscape.

It appears that we have different rules for different people.
LAW ABIDING TAXPAYERS will be stuck with the bill when these land areas have to be cleaned up once these law-breakers clear out and disappear into the night.
I always find it amusing when some people stick up for others who abuse the system for personal gain and think that people that are apposed to this behavior are “KARENS”
What if one of these Trucking Companies (may not be Trucking company, could simply be a slum landlord) decided to buy the property next to yours and set up a similar outdoor parking lot and rent it out for a similar purpose.
Who would be the KAREN then.

Why not remove the fences and tow the vehicles away? Set fines high enough to cover the cost of the removal and police for security presence. Charge the property an equal amount (for all the tows) for Admin costs. That cost of business will add up too fast to be feasible. The tow companies will be happy. There would have to be dozens of companies to move that many trucks in a night. Big operations I know, but would likely be well worth it.

The town would just create another “ugly” site after impounding the trucks and trailers in question!It’s easy for the mayors of HH and other regional municipality to complain, but none of them have any alternatives to offer – and, frankly, give it another 10 years or so, and these pristine farmlands will end-up becoming urban bedroom communities, all paved-over with the wildlife being pushed even further out.
IMHO, it’s also the duty of municipal administrators to plan for the industrial and commercial community and provide them decent, cost-effective land to erect their plants and/or trucking yards.
Let’s face it, when transport companies won’t be able to afford deliveries into the GTHA, all these municipalities will be hard-pressed to serve their tax-payers……and be overrun with last-mile (heaven forbid, autonomous) cube-vans, small trucks, which – btw – also need to be parked somewhere!

Simple fix bring in the MTO and pull every plate from ttractors and trailers. Suspend the operating authority. of every trucking company parked there. Until they put the land back to which is was they don’t get there equipment or operating authority back.
The Owner of the land will also have to pay a penalty of say 500 thousand dollars or forfeit the land .
These trucks should be towed ans impounded!
Do away with all that bureaucratic red tape and start giving out huge fines and eviction notices .it’s obvious they aren’t using the land to farm. When they start applying for a day in court then lay down the law and tell them absolutely no. They didn’t apply notice to the city of their plans.they are in violation. It’s only goingget worse when the garbage starts flying around .
You need to get the names on the doors of the trucks and trailers. Transport companies have rules where their equipment can and cannot be parked. As someone who uses to work for Manitoulin Transport, their equipment is not allowed to just park anywhere. Start towing the equipment and impounding it. You will see equipment moved off the properties where they are not supposed to be parked swiftly.
Seems really stupid of the governing body to bring in thousands of trucks to Canadas largest truck warehousing with no forethought as where to park them … don’t blame the operators this is all government … land prices here have skyrocketed
If they are filling in ditches, have trucks leaking fluids and so on and so forth then call the Ministry of Environment, Ministry of Natural Resources and the local conservation authority. They will shut them down right then and there. Stop clowning around with bylaws. Get a court order and seize the equipment to cover the clean up costs.
These fly by night Operations should be re-examined as money laundering Operations and prosecuted under criminal law. Seize all the trucks, trailers, etc.
The only solution is the gov and industry to get into the business with building at 5 truck stops within 25 kms of the GTA with a min of 600 semi truck parking spots and 100 straight truck / bus parking spots and 200 trailer drop spots and 120 tractor units and 200 regular car and pickup spots and 90 Ev charging units spots in each location . These could be done on used gravel pits second grade farm land . They should also have a min of 90 family units for employees and truck driver families and 120 units of over night housing with 40 of those rooms (units) setup to have access for power wheelchairs and PSWs care if needed. this needs to be funded by road tolls on certain roads on trucks within 40 kms of Toronto and a $30 fee on every unit over 15 meters long per drop and $50 per drop if delivers on a trailer over 15 meters if overnight parking is not supplied by the customer with bathrooms. I would like to see at 3 of the locations a 7 to 9 bay( repair shop co op )with 1 military style tow truck and 2 service units and 1 full size disabled wheelchair van.
I doubt Ford and Prabmeet will do anything to stop this nonsense? After all Ford want highway 413 for his friends in Vaughan to be able to drive a few minutes faster to Brampton. God forbid they use the 407? that would cost them money to pay a toll. Ford has an idea he will, be able to build a tunnel under the 401 and has given $ 9.1 million to study if this can be done. If Ford has read the news about how the tunneling under the 401 for the Metrolinx, he would already know that the tunneling there has been a pain due to soil shifting from the vibration rom the traffic overhead. If I have read the news reports correctly, Ford has already given money for construction to do the tunneling under the 401. I am not certain what Fords brother, the former Mayor of Toronto, caught but I think Ford must have the same problem. Before Ford bankrupts Ontario, he needs to go!!!

This is well documented, known and talked about. Unfortunately, as the article identifies, the moral high ground of the law is cumbersome and costly. The immoral, illegal way is easier, cost effective (maybe only for a fast buck) and seems to have no repercussions.
If/when the lengthy court battle ever comes to fruition it seems close up shop and disappear is the chosen route.
Oh ya, with taxpayers footing the bill all the way along…..

Why are we becoming such a lawless country. they brought the full weight of law down for truckers who were protesting a COVID shot, these “operators” are destroying wildlife, farm land and NEXT TO NOTHING IS BEING DONE.

I am pretty sure if a resident of Halton Hills tried to use land that was not zoned or permitted for the use intended they would be prosecuted immediately . Who owns this land ? and why are they able to allow it to be used for purposes that it is not zoned or legally intended for ? The truck yards are unsightly , dangerous , we have had shootings and I am sure many other crimes committed in them already .
Raise the fines to a level that would hurt in their pockets and make it immediate and definite , not something they can get one of their lawyers to talk the court down or out of.
I know it is not as simple as this , but again , if this were a single individual using it for a market garden or something to aid their income they would be stopped immediately. Of that I have NO DOUBT

lol fines – some of these yards charge 500 a month and have 100/200 trucks and trailers – amounting to 50/100k a month in profit – a 115k fine is nothing in comparison to the two years of profit they can bring while judicial figures it out.
