OEM takes transmission manufacturer to task
PORTLAND, Ore. — Freightliner is seeking redress from the US Federal Court for conduct by Allison Transmission, a division of General Motors, it deems to be anti-competitive.
The lawsuit alleges that GM, through its division Allison Transmission, is abusing its market power to limit competition and improperly exclude competition from the market for automatic transmissions in diesel powered buses, motor homes, and walk-in vans, the class 6/7 truck market, and certain portions of the class 8 truck market.
Specifically, the suit alleges that GM/Allison has violated certain provisions of the Sherman Antitrust Act and the Clayton Act, relative to actual and attempted monopolization, and the Robinson-Patman Act relative to price discrimination.
The plaintiffs, who include Freightliner subsidiaries Freightliner Custom Chassis and Thomas Built Buses, are seeking an injunction against further violation, money damages and attorney fees.
