Alberta caps liability exposure for truck rental and leasing companies
EDMONTON, Alta. — Alberta has introduced an amendment to the Traffic Safety Act which protects vehicle leasing and rental companies.
Bill 49, introduced Nov. 20, establishes a $1 million cap on vicarious liability awards for owners of vehicles leased for 30 days or more. The Truck Renting and Leasing Association (TRALA) has been seeking the change for some time now. The province didn’t extend the provisions to those companies that rent or lease vehicles for less than 30 days.
Previously, the leasing or rental company could face unlimited liability claims in Alberta simply based on their ownership of the vehicle.
