Michelin Canada sues for alleged patent infringement

MONTREAL — Michelin North America Canada has filed a suit in Canadian federal court against Distribution Nortop and Rechapage Nortop Richmond, alleging design patent infringement.

The move is part of ongoing efforts by Michelin to protect “proprietary designs and technology investments,” the tire manufacturer stated.

In the suit, Michelin is demanding that Nortop stop importing, distributing and selling treads that allegedly infringe upon Michelin patents. Michelin alleges that Nortop’s retread business has infringed on patents for Michelin’s XDY-3, XZY-2, XDS and XDN-2 treads in Canada.

“Michelin refuses to tolerate look-alike tires or retreads that trade on Michelin expertise and profit from Michelin innovation,” the company stated.
