Michelin files suit against Nortop for alleged design patent infringement

MONTREAL, Que. — Michelin North America has filed suit in the federal court of Canada against Distribution Nortop and Rechapage Nortop Richmond for alleged design patent infringement. The suit regards several patented Michelin brand tread designs including models XDY-3, XZY-2, XDS and XDN-2 that Michelin officials say are being infringed by Nortop.

In the suit, Michelin is demanding that Nortop immediately stop importing, distributing and selling treads that they claim infringe Michelin patents. Michelin is also demanding a recall of Nortops treads in inventories or in transit to stop any future use.

This is the latest action in Michelins continuing fight to protect its proprietary designs and technology investments, the company said in a release. Michelin refuses to tolerate look-alike tires or retreads that trade on Michelin expertise and profit from Michelin innovation.
