Enforcement of Canada’s ELD mandate to be phased in over a year

Transport Canada has reaffirmed its commitment to a June 12 rollout of Canada’s electronic logging device (ELD) mandate, but with a “progressive enforcement period” lasting 12 months.

Transport Minister Omar Alghabra issued a statement, saying “As Minister of Transport, I am firmly committed to this timeline – these devices will further strengthen road safety in Canada. At the same time, the impact of Covid-19 on commercial vehicle operations has been unprecedented and must be acknowledged. As such, with the support of provinces and territories, and in consultation with industry, we will work together on the successful and effective implementation of a progressive enforcement period. This will give sufficient time for industry to obtain and install certified electronic logging devices without penalty as of June 12, 2021. Early enforcement measures will consist of education and awareness.”

He urged carriers to equip their trucks with ELDs “as soon as reasonably possible.”

The Private Motor Truck Council of Canada (PMTC) has been imploring Transport Canada to phase in enforcement of the mandate. Its president, Mike Millian, welcomed today’s announcement.

“The PMTC is very pleased with Transport Canada’s commitment to phase in enforcement, beginning with education and awareness only at the beginning,” he told Today’s Trucking. “The PMTC has been very vocal asking for an enforcement deferral to allow industry and suppliers time to select from an adequate list of approved devices.”

The Canadian Trucking Alliance (CTA) also commended Alghabra, noting it submitted to the Council of Ministers Responsible for Transportation and Highway Safety a strategy for a 12-month, phased-in enforcement approach for third-party certified ELDs beginning in June.

CTA says its recommendations include “meaningful and gradual enforcement” of the regulation, over the course of 12 months. Full enforcement will commence in June 2022.

“The CTA enforcement strategy provides the people of Canada with the safety benefits they have come to expect and deserve from this regulation, which will allow the full benefits of ELDs to come to fruition within in 12 months,” said CTA chairman Jean Claude Fortin. “The strategy reflects the realities of transitioning to third-party certified ELDs and ensures a smooth 12-month transition from paper logbooks to electronic devices for ELD vendors, carriers and drivers.” 

The Canadian Council of Motor Transport Administrators has assured CTA that it has formed a committee to develop the progressive enforcement strategy.

“CTA is committed to working with the provinces, territories and federal government in a comprehensive and fair manner that sees the mandate receive progressive and full enforcement within a 12-month period. The introduction of phased-in enforcement strategies is not unusual to our sector; however, CTA sees no valid reason to extend an ELD phased-in enforcement approach beyond a 12-month period,” said CTA president Stephen Laskowski.

“Government and industry must commit to this progressive, 12-month process for the advancement of highway safety and to reinforce our commitment to safety we made collectively following the Humboldt tragedy.”

  • How do you go about finding what companies may be exempt from requiring ELD?

    I drive for a company that operates 1 truck within 160kms of home terminal.

      BUT, understand that the laws around HOS are not changing. If you are currently exempt from paper logs you are exempt from ELDs.

  • Canada is playing around with the ELD it is no secret that if you go to the USA to deliver goods you have to get the electronic log book and it has been for sometime yet so what is the problem??? it is easy to use and mke life easier it is no joke.

    • The issue currently Robert is that no ELDs have been approved yet in Canada. Unlike the US, Canadian ELDs must be approved by an origination approved by TC, whereas in the US ELD providers can self approve. With 3 months left until the deadline TC has only approved one origination to approve ELD’s and as of today none of the ELDs that are on the market have been approved. TC themselves estimated it would take up to 12 months for a carrier to install and train drivers on ELDs.

  • I drive a ’97 tractor moving construction equipment once every month or so within 160 km radius. This is a one truck operation usually logging less than 10,000 km per year. Can I be exempt from from needing a ELD?

    • Yes. The rule states if you didn’t need a paper log sheet prior, you won’t need an ELD. Also the ELD mandate is only for federally regulated carriers. If your not running PRP plates your most likely provincially regulated, not federal

      • More tyranny, more control over our work.This is not a safety concern at all..for over 80 years goods were delivered with no elogs and the accident rates have gone up with elogs..bad move!

  • Has a list been published with the certified ELD’s that can be acquired?
    This is still not an intra-provincial mandate as well?

  • You’re running short haul and your truck us pre 2000. You’re good to go.
    ELDs can only get ECU data from 2000 and newer.

  • As far as I’ve seen trucking, is everone is in a hurry now days because of these damn eld’s. I can’t believe you drivers love these eld’s so much. Haven’t seen the roads safer so far. I’ve seen it worst. I miss the good old days of trucking. Trucking is a job and a life style, not a career like these big corporates want you to think!

  • How can you enforce a mandate when there are no certified devices 90 days before the deadline! The Federal Government has fallen down on this one

    • They are incompetent! Not even one truck driver at the Minister of Transport and you ecpect them to regulate a truckers life!?

  • BE AWARE!!.. If your locked in already with a provider. ie: Omnitracs. You are waiting for them to be certified, which will happen for the big providers. BUT these providers have multiple platforms which they sell at various pricing. Tablets or bring your own device ( cell phones ) etc. but not all of their platforms may be certified. So if you have a platform that you have invested in for along time now their is no guarantee it will be certified even though your provider has been. Now you will be upgrading to the platform they can offer and changing your entire fleet at a huge cost while trying to get it done with everyone who waited to the last minute. Someone please tell me if I am wrong because my provider isn’t saying anything.

  • I am the compliance manager for a company that transports travel trailers and fifth wheel camper trailers. We are exempt in the U.S. from ELD’s as long as what we are transporting is being towed with its own wheels in contact with the pavement. Wonder if Canada will honor this exemption? Assistance would be appreciated. Thanks in advance.
