STA helps re-write Sask. Liens Act

REGINA, Sask. – The Saskatchewan Trucking Association (STA) has helped with a re-write of the Commercial Liens Act, making it more beneficial for the trucking industry.

The most important change the group suggested for the industry is the ability of the trucker/fleet to claim a lien against goods hauled for payment of its services.

The new language also repeals all other legislation in the province regarding liens against fleets having work done on their vehicles.

If work is performed on a vehicle and the person refuses to release possession of the truck, the trucking company can make an application to the court to resolve the dispute. The applicant will be able to pay the amount of the lien in court at which point the claimant will be required to release the vehicle to the trucker. However, the court will not actually release the money until the dispute has been settled.
