OAKVILLE, Ont. — The issue of errant truck tires has quieted in the past few years, but was brought back in the most unfortunate of circumstances after a bouncing wheel from a tractor-trailer ended the life of a female motorist on Thursday night.The women, whose name has not been released, was travelling along Queen Elizabeth Way near Oakville when a set of rear tires came loose from the tractor-trailer, bounced over the median and struck her car.The 41-year-old woman was driving a Mercedes westbound around 9 p.m. and her car careened into the ditch after one of the tires hit it. The woman was pronounced dead at the scene. Another tire struck a tractor-trailer, causing it to lose part of its load. The driver was not injured, reported the CBC News.The truck with the missing tires was stopped down the highway by the Ontario Provincial Police. The tractor-trailer is being held for inspection and police stated that charges are likely.A few years ago, Ontario enacted an absolute liability provision on trucking companies for wheel-off incidences – even if steps were taken to prevent the incident from occurring.The provisions of Section 84.1 (1) were challenged in the courts as a violation of section 7 of the Canadian Charter of Rights and Freedoms because it infringes on the security of the person and does not allow the defence of due diligence. The Ontario Court of Appeal upheld the absolute liability provision and an application to the Supreme Court of Canada was later struck down.Under the provision, owners and operators of commercial vehicles are absolutely liable when wheels detach from their vehicles with fines up to $50,000.– with files from
